United Kingdom – Equipment and Protective Systems Intended for Use in Explosive Atmospheres Regulation 2016, (EU Exit) Regulation 2019


United Kingdom Product Safety and Standards released the guidance for Equipment and Protective Systems Intended for Use in Explosive Atmospheres Regulation 2016 which will apply only if the UK leaves the EU without a deal.


The EU Withdrawal Act 2018 preserves the Regulations and enables them to be amended so as to continue to function effectively in case the UK has left the EU. The Product Safety and Metrology etc. (Amendment etc.) (EU Exit) Regulation 2019 fix any deficiencies that arose from the UK leaving the EU (such as references to EU institutions) and make specific provision for the UK market.

United Kingdom – Placing Manufactured Goods on UK Market After Brexit


Effective October 31, 2019


If the United Kingdom is to leave the EU without a deal, CE marked products that meet EU requirements can continue to be placed on the UK market without any need for reassessment or re-marking.


Where any assessment required is carried out by an EU-recognized body, they can continue to use the CE marking as this marking will continue to be recognized on the UK market. It is intended that this will apply for a time-limited period, and sufficient notice will be given to businesses before that period ends. This also applies to goods manufactured in accordance with the Radio Equipment Directive (RED).


In terms of whether manufacturers can print the label in the manual only and not on the product itself, this varies depending on the specific regulations that apply to the product. The rules relating to where the marking should be placed, can be found in current EU legislation.
